Issues of development of obligatory insurance of civil liability proprietors of surface transport vehicles and the ways of their decision

The article deals with the issue of compulsory insurance of civil liability of owners of vehicles in Ukraine, the role of this type of insurance in the insurance market. It is emphasized that nowadays one of the problems which restrain the development of insurance of civil liability of vehicles owners is incomplete compensation of damages caused by a traffic accident. The author identifies shortcomings in the legislation of Ukraine concerning the insurance of liability of vehicles owners, leading to partial damages caused by the onset of a traffic accident. In this regard, the aim is to solve the problem to ensure the compensation of material losses for insurance of civil liability as a prerequisite for the development of the insurance market, and to develop measures to protect property interests of victims. In a specific example analyzed a case where the amount of money paid by the insurer under the terms of liability insurance does not always cover the amount of damage. It was proposed to make amendments to Art. 30 of the Law of Ukraine ""On mandatory insurance of civil liability of owners of vehicles” which allow, in case of severe damage of the vehicle, the injured party to claim, from the person responsible for the caused damage, a compensation of the part of losses (VAT) incurred but not reimbursed by the insurer.
