Problems of concession development in Ukraine


The article reveals a gradual transformation of the state’s role in the context of implementing key priorities of different economic sectors. It is determined that due to the dynamic transformation of market relations the role of government gets qualitatively new essential characteristics rather than decreases. Particular attention is paid to the possibility of increasing the competitiveness of the national economy based on the advantages of public-private partnership in the form of concession. The theoretical aspect of concession typology is justified. The author shows advantages of upgraded concession and gives examples of its application. Different approaches to defining types of concession agreements used in the international practice of public-private partnership are described. The author researches the main types and schemes of concession instruments and identifies their benefits for subjects of concession relations, with an emphasis on the changes of a level of state control over the object of concession. The possibility and extent of government influence on the activities of the concessionaire are analyzed. The procedure for operating the object by the concessionaire and the terms of ownership of the concession object upon the completion of which it becomes state-owned are established. The article provides examples of state title objects which can be granted on concession under the legislation of Ukraine.
